Irrevocable Trust Can Avoid Medi-Cal Recovery Claim

A client walked into my office the other day with an all too familiar story. His wife was in skilled nursing and the bills were adding up. They would soon run out of money and need to apply for Medi-Cal to pay the bill. He said “We want our two children to inherit our home when we are gone.”He wanted to know if joint tenancy title would work to avoid a Medi?Cal recovery claim.
I told him that there were a variety of different methods for protecting his home but that joint tenancy was not one of them. That came as a shock to him and probably would to many couples or individuals who are still relying on this simple approach to pass the property on to their children or other heirs.
